Fears about the fate of the 2005 SD "Trigger Act" unwarranted

Some because they are simply misinformed, and others because they are intentionally sowing fears and confusion hoping to derail the current abortion legislation and petition efforts, are saying the South Dakota "Abortion Ban Trigger Act" enacted in 2005 would be undone if the current abortion legislation is passed. It's simply not so. You can read a detailed legal analysis of the current Abortion Prohibition Initiative Measure and its effects, if any, on the Trigger Act here.

Section 15 of the current initiated measure was carefully drafted to insure it would not repeal the 2005 Trigger Act. The current initiated measure only effects Roe v. Wade. Whereas Roe v. Wade, Doe v. Bolton and probably even Griswold v. Connecticut would have to be overturned before the Trigger Act would take effect. So, pro-lifers can relax and not worry that we are somehow undoing past progress on the LIFE issue in South Dakota.
